Leslie Harris here,  and I’m a little surprised that this has made the news, but the Spangler Candy Company, maker of Dum Dum lollipops has won a case against Tootsie Roll Industries. The problem here is that Tootsie Roll has their Charms Mini Pops, and Dum Dums say it looks too much like their product. So Tootsie Roll has to stop using that design at least for now.

The judge decided that Tootsie Roll was trying to copy Dum-Dums in order to trick people into buying Tootsie Rolls instead of Dum Dums.

Really?

Okay, here’s what I don’t get, when I buy suckers for kids, which is basically the only time I’m going to buy suckers, I just buy whatever the cheapest ones are. I don’t care what they look like, I’m looking for the biggest bang for my buck.

What about you? Would you buy Dum Dums instead of Charms Mini Pops? Or Charms instead of Dum Dums? Or would you just buy whatever is cheapest?
